The Law School, University of Jammu, organised a guest lecture titled "Mediation Act, 2023: A Paradigm Shift in Dispute Resolution" as part of its ongoing efforts to enhance legal knowledge and understanding of current legal trends. Justice Rajesh Tandon (Retd.), a Senior Advocate of the Supreme Court of India, delivered a lecture that provided in-depth exploration of Alternate Dispute Resolution (ADR).
Justice Tandon's presentation covered various ADR mechanisms, including arbitration, negotiation, conciliation, and mediation. He detailed their unique characteristics and operational differences, stressing the importance of ADR mechanisms as established under relevant statutes and even Section 89 of the Civil Procedure Code. His discussion also highlighted the challenges facing effective ADR implementation, which prompted a lively dialogue among the attendees.
The event included a notable role-playing exercise led by a team of students namely Sushant Sharma, Anshika Gandhi, Hemanya Puri, Suhasini Sharma, Kasak Gupta, Parth. This exercise vividly illustrated the practical benefits of mediation, such as enhanced communication, relationship preservation, and efficient dispute resolution. The students' performance provided a hands-on demonstration of mediation’s potential, complementing Justice Tandon’s insights.
The positive feedback from students highlighted their gratitude for the opportunity to learn from a knowledgeable expert in the field. The combination of theoretical exposition and practical exercises offered a well-rounded perspective on the Mediation Act, 2023, emphasizing its relevance and application in contemporary legal contexts. Overall, the session fostered a meaningful learning experience and sparking a greater interest in mediation among the attendees and faculty members.
